IP High Court Chief Judge’s Visit to the United States Patent and Trademark Office (USPTO)

On April 25, 2017, IP High Court Chief Judge Misao Shimizu visited the United States Patent and Trademark Office (USPTO). The Commissioner for Patents, the Director for International Affairs and other officials described the recent situation mainly with regard to patent examination, in place of the USPTO Director as the position was vacant at the time of visit. At the Patent Trial and Appeal Board (PTAB) office, the Chief Judge of PTAB and other judges explained the ongoing situation regarding trials for patent invalidation after the 2011 revision of the Patent Act. Chief Judge Shimizu explained the practice of the IP High Court regarding the defense of invalidity in patent infringement lawsuits and the JPO’s decisions on trials for invalidation.
