Participation in the First Intellectual Property Judges Forum Held at WIPO Headquarters

From November 7 to 9, 2018, Judge Akira Katase of the IP High Court participated in the first Intellectual Property Judges Forum held at the World Intellectual Property Organization (WIPO) Headquarters in Geneva, Switzerland.
Inaugurated this year, the Forum’s purpose is to provide an opportunity for courts around the world to exchange opinions on IP-related issues they commonly face as well as promote their capacity building. The first Forum attracted more than 110 current and former judges from 65 countries.
Judge Katase participated in the session on “Judicial Discretion in Approaches to Remedies” as a panel member. In the session, free discussions were held on how judges exercise their discretion mainly in the processing of preliminary injunctions and injunctions and damage in patent infringement suits. Judge Katase explained about Japan’s practices, specifically introducing the principle of upholding claims for injunction based on findings of fact made for infringement and various consideration factors assessed in calculating estimated lost profits. He also actively exchanged opinions with other members.
