Participation in International Conference in China (Shanghai)

On November 17 and 18, 2016, Judge Masaki Sugiura of the IP High Court participated in the International Conference on Building Respect for Intellectual Property – Stimulating Innovation and Creativity / The 13th Shanghai International Intellectual Property Forum (hosts: World Intellectual Property Organization (WIPO) and Shanghai Municipal People’s Government) held in China (Shanghai).
Judge Sugiura participated in a session entitled “IP Adjudication and Jurisprudence: What are the Emerging Issues?” as a panelist and introduced the legal system and actual situation in Japan concerning the tentative and final remedy for the infringement of intellectual property rights while referring to the Grand Panel system, and participated in the discussion on a court’s discretion whether or not to order an injunction against infringement and special provisions concerning the IP litigations. In this session, the former judge from Australia acted as a moderator and in addition, Judges (including former judges) from the UK, South Africa and China introduced the system and actual situation in each country.
