Participation in Symposium at EPO

On July 7, 2016, Judge Motoyuki Nakashima of the IP High Court participated in a symposium concerning “Unitary Patent & Unified Patent Court” at the European Patent Office (EPO) in Munich, Germany. Judge Nakashima participated, together with Professor Willem Hoyng from the Netherlands (Tilburg University), Judge Tobias Bremi of the Swiss Federal Patent Court, attorney Jennifer Polse from the U.S., and attorney (former judge) Seong-Soo Park from South Korea, in a session entitled “UP & UPC: an international perspective” moderated by attorney Gabriel Cuonzo from Italy. Judge Nakashima gave a speech entitled “The use of expert knowledge about technologies in patent litigation of Japan” in the session to introduce the characteristics of the Japanese IP litigation systems, with a focus on the judicial research officials system and technical advisors system in Japan, from the standpoint of use of expert knowledge about technologies. Then, the participants engaged in a lively Q&A session under the moderation of attorney Cuonzo regarding the actual situation of the session given by technical advisors in an explanatory session in Japan, and the comparison of the session with the examination of expert witnesses used in the U.S. and South Korea.
