Participation in the 2019 Intellectual Property Judges Forum Held at the WIPO Headquarters in Geneva (From November 13 to 15)

From November 13 to 15, 2019, Judge Aya Takahashi of the IP High Court participated in the 2019 Intellectual Property Judges Forum held at the World Intellectual Property Organization (WIPO) Headquarters in Geneva, Switzerland.
Amid the rapid technological innovation and the accelerating global utilization of intellectual property, the Forum aims at providing an opportunity for IP judges around the world to exchange opinions on IP-related issues they commonly face, as well as promoting their capacity building. The Forum attracted about 130 current and former judges from 74 countries.
Judge Takahashi participated in the session titled “Emerging issues in patent” as a speaker. In the session, panel discussions were held on the recent issues concerning patent eligibility and the issue of overlapping of patent law and antimonopoly law. Judge Takahashi explained the decisions on patent eligibility rendered by Japanese courts, and actively exchanged opinions with other panelists on the importance of predictability of court decisions on patent eligibility and the difference in status between the requirement of patent eligibility and other patentability requirements in determining the validity of patents.
